Students with disabilities are entitled to services and accommodations that would provide them a free and appropriate public education. Legal representation may be necessary for special education students to receive what they deserve, whether the issue is eligibility, appropriate services and accommodations, or school placement. Due process complaints are filed with the Bureau of Special Education Appeals.
STUDENT DISCIPLINE
Student discipline is a huge concern for parents when a school is seeking to suspend or expel a child. Schools may discipline students who violate the student code of conduct or who are charged with felonies in Juvenile Court. Special education students have additional rights during disciplinary procedures.
Children ages 7 to 16 accused of criminal offenses are charged as delinquents or youthful offenders in Juvenile Court. The juvenile delinquency system is distinct from the adult criminal system. There are special laws and rules.
DEPARTMENT OF CHILDREN AND FAMILIES (DCF)
The Department of Children and Families (DCF) investigates allegations of abuse and neglect. Understandably, families are scared of the investigation and potential outcome of the process. You may appeal an unfavorable decision through the Fair Hearing process and then to Superior Court.
CHILD IN NEED OF SERVICES (CHINS)
Schools and parents may file a CHINS petition in Juvenile Court. The court may transfer temporary custody of the child to the Department of Children and Families.
